PRIVACY STATEMENT ON THE PROCESSING OF PERSONAL DATA

This privacy statement describes the characteristics of the processing of personal data collected through the website http://dedar.com/it/ (the “Website”) by DEDAR S.p.A., with registered office in Via S. Giovanni sul Muro 5, 20121 Milan, Tax Code and VAT 03187590157 (hereinafter “Dedar”).

Data controller

The data controller of the personal data of users collected through the Website (“Data”) shall be Dedar.

Data collection

Personal data provided by users

Some areas of the Website require users to provide their personal data: more specifically, the areas related to the sign-up of an account on the Website and to the subscription to the newsletter service. The provision of such Data shall occur on a voluntarily basis: if users do not provide said Data they can still browse the Website without benefiting from these services.

The Data are collected if and to the extent they are provided by users. The Data which are absolutely necessary to perform the activities required each time are marked with an asterisk.

Users are invited not to provide Dedar with third party’s personal data unless it is strictly necessary (i.e.: if the user does not have his own e-mail address or does not have any direct contact addresses): in this case, please be aware that user must fulfill all legal obligations on the protection of personal data and, more specifically, inform said third parties of the provision of their data and receive their consent if required.

Personal data automatically collected by the Website

Each time users access the Website, our systems automatically register and analyze the access data (like your provider’s IP address, information on the browser used, pages visited, website you are visiting us from, date, time and duration of each visit). The information is automatically collected by the Website and does not require any action by users.

Purpose of the processing and period of storage of Data

Dedar processes Data in strict compliance with applicable laws on data protection and with the instructions provided by the Italian Authority for the protection of personal data.

Registration of an account and online purchases

The Data provided by users in the section “Register” of the Website (including delivery and payment data) shall be processed to allow users to register an account on the Website, add their preferred products in the wish list and possibly complete the purchase of the required products. The processing includes customer care activity, sending official notifications on the status of the order, performing obligations required by law and sending the newsletter having business and promotional content concerning Dedar’s activities and the most important news related to it, its products, as well as exhibitions and events Dedar shall attend.

For the same purpose, the Data shall be sent to third party suppliers of ancillary services for online sales, like shipping agents and carriers (with respect to the shipping and handling of purchased products) and bank institutes (to manage payments and reimbursements), in addition to third parties supplying newsletter services: these parties shall process the Data as autonomous data controllers or data processors, depending on each case; in the latter case these parties shall process the Data pursuant to the data processing agreement executed by them and Dedar. The provision of the Data is required to create the account and to receive and accept the purchase order sent by the user.

The legal grounds of such data processing lie in the need to perform a contract to which the data subject is a party, to take steps at the request of the data subject prior to entering into a contract and to comply with a legal obligation to which Dedar is subject.

The Data shall be stored for a period of time strictly required to fulfill any taxation and accounting obligations related to the sale of Dedar products provided for by laws and regulations.

With regard to the sending of the newsletter, the legal grounds of such data processing lie in Dedar’s legitimate interest to promote its own activities and products. The latter is compatible with the position of the data subjects since it is reasonable to assume that who creates an account on the Website is interested in staying informed on Dedar’s activities and products, as well as on the events Dedar will attend.

At any given moment users can object to such processing and cancel their subscription to the newsletter service, by following the instructions provided in each newsletter or by sending a special notification to Dedar to the addresses indicated in the section “UsersRights”, expressing their intent to unsubscribe from the newsletter service and to obtain the erasure of the Data collected by Dedar.

With reference to the account registration, it will be deactivated in case no log-in is made for more than 36 months after the registration date. Dedar will send a request related to the users’ account a month in advance before the expiry date; where user responds positively to such request, the account shall be kept open for the following 36 months.

In case any purchases are made, the Data shall be stored for a period of time strictly required to fulfill any taxation and accounting obligations, even provided by any regulation, related to the sale of Dedar’s products.

With reference to the processing of personal data to send the newsletter, without prejudice to the user’s right to object to processing at any time, the Data shall be processed and stored for 24 months after registering the account.

Newsletter subscription request

The Data provided by filling in the form to register for the newsletter service shall be processed to allow the user to benefit from the newsletter service and therefore to receive the newsletter related to Dedar’s activities, the most important news concerning it, its products, as well as exhibitions and events Dedar shall attend (which will be sent via e-mail). For the same purpose, the Data shall be provided to third party suppliers of newsletter services. These parties shall process the personal data as data processor pursuant to the data processing agreement executed by them and Dedar.

The provision of Data for this purpose is optional: any refusal will prevent Dedar from sending to the user the newsletter.

The legal grounds of such processing lie in the need to perform a specific request coming from the data subject.

The Data shall be stored and processed up to 24 months after registration.

Replies for inquiries

The Data provided by sending an inquiry to one of the e-mail addresses indicated in section “Contacts” of the Website shall be processed to give a feedback on the inquiries sent and to provide assistance to users and/or Dedar’s clients.

The provision of Data occurs on a voluntary basis. A refusal will prevent Dedar from contacting or from giving a feedback to users.

The legal grounds of such processing lie in the need to perform a specific request coming from the data subject.

The Data shall be stored and processed up to 12 months after receiving the last inquiry.

Recipients of Data

The Data of users, with regard to the aforesaid purposes, may be also sent to public authorities where required to fulfill obligations set out by the law.

The data processors include advisors and suppliers of ancillary services and instrumental to those supplied by Dedar, as, by way of example but not limited to, companies which supply Website management services entrusted by Dedar.

Users’ Rights

At any given moment users can:

  1. obtain access to the Data;
  2. obtain the rectification or cancellation or, where applicable, the limitation on their processing;
  3. object to the processing of the Data;
  4. where applicable, receive the personal data provided to Dedar in a structured, commonly used and machine-readable format, in addition to sending these to another data processor without any hindrance by Dedar;
  5. lodge a complaint with a supervisory authority.
